Appeal by Mr. PUN Ting-chau

Thank you for your letter to Higginson dated

1st October 1975. We have received a similar petition from Mr. PUN Ting-chau to His Excellency the Governor, dated 1st October 1975, and are now taking appropriate steps to deal with the matter.

The Attorney General has also received a copy of the 'appeal ' from Mr. Pun and has referred the matter to the Commissioner, ICAC, for investigation of the allegations of corruption by the Judges of the Supreme Court. We are waiting for a report from ICAC before giving consideration to further action, which may involve a prosecution of Mr. Pun for criminal libel.

As regards an appeal to the Privy Council on the part of the Crown, our policy is that we do this only in very exceptional circumstances involving an important point of law. This does not appear to be so in this case. We shall keep in view, however, a copy of the judgement from the Supreme Court, when available, before making a final decision, when we shall report to you further.
