(a) it is likely that the life of the prisoner

will be endangered or his health permanently injured by further imprisonment in the Colony;

(b)

or

that it is expedient for the prisoner's safer custody or for more efficient carrying out of his sentence that he should be removed as there is no prison in the Colony in which the prisoner can properly undergo his sentence.

I do not consider that any legal case exists for Godber's removal under the Colonial Prisoners Removal Act. Such a move would, in any event, cause deep public resentment after our efforts to bring Godber back to Hong Kong to stand trial.
