Thank you for your letter of 2 March addressed to Andrew Stuart, from whom I have recently taken over as Head of Hong Kong and Indian Ocean Department.

s statements, during both the Godber trial and his Midweek Television interview, have been carefully examined to see whether they could form the basis of a prosecution. However, it has been concluded that, despite the deplorable nature of

s admissions, it would be impossible to base a charge on them. This is partly because of a lack of evidence concerning the alleged incident which would stand up in a court of law;

and, more important, because, even if

s account of the event

is accurate, he could only be regarded as an aider and abettor if it could be shown that he intended to encourage, and wilfully did encourage, an offence to be committed.
