I enclose copies of a letter and memorandum which Brook Bernacchi addressed to Lord Goronwy-Roberts just before he left Hong Kong.

Lord Goronwy-Roberts would like as a matter of courtesy to send Bernacchi a personal reply. He has given his preliminary approval to the enclosed draft. However, since most of the points relate to areas of policy which fall directly under your own authority, he would be grateful if you would first look at the draft. I am afraid there has been some delay in agreeing the draft at this end, since we have been consulting the Legal Advisers on how best to reply to Bernacchi's points on Chinese illegal immigrants. One question in particular, which has caused us some difficulty, is whether illegal immigrants are entitled under the Immigration Ordinance to be informed of a right to appeal to you before they are finally refused permission to enter. This is the point in the fifth paragraph of the Reform Club's memorandum. accepted this would obviously raise problems of timing which would complicate the whole operation. We have therefore decided not to reply to the point directly in answer to Bernacchi, but will be dealing with it separately in a commentary which we are preparing for Alan Donald in answer to his letter to me of 17 January.
I should be glad to receive any comments on the present draft, if practicable by telegram. An interim reply has been sent direct to the Reform Club.
