MP'S LETTER: TRAFFIC ACCIDENT IN HONG KONG

1.

Lord Goronwy-Roberts wrote to Mr R J Carter MP on 27 June

about the death of Mr Kwan Kung in Hong Kong. Mr Carter has now written to Miss Lestor enclosing further correspondence received from Hong Kong in this case.

The background is set out in Mr Crowson's submission of 17 June. Lord Goronwy-Roberts's previous letter to Mr Carter was based on Hong Kong telegram no. 75 and on the Deputy Secretary for Security's letter of 4 June. The latest letter from

Mr Kwan Chung Lam (Mr Kwan Kung's son) appears to be no more than a rehearsal of the allegations that have already been carefully investigated in Hong Kong. There is, however, one point which he also mentioned in previous correspondence, but which has never been specifically dealt with in the replies from Hong Kong. This is the allegation that there was an eye-witness of the accident whose evidence was disregarded. I therefore think that we must write to Hong Kong again.

However, we should not lead Mr Carter to expect that there will be any substantive change in our previous decision. Nor do I think we should allow to pass unchallenged the remark in the covering letter from the "Christ the Worker Catholic Church" that the Foreign Office and the Independent Commission Against Corruption. regard this as a small matter. Mr Kwan's allegations have received extensive investigation at all levels. He may genuinely believe the explanations to be untrue, but it is difficult to see how any Government could responsibly agree with him on the evidence.

I submit a draft letter to Mr Carter accordingly. written to Hong Kong.
