I refer to your minute of 20 August to Mr Dinwiddy.

2. It is not clear whether Kudryavtsev made specific reference to the 1968 Merchant Navigation Treaty. It would be surprising if he had, since it is clear that the Treaty has no application to Hong Kong. Article 2 specifically provides that "The territories of the High Contracting Parties to which the present Treaty applies are:

on the part of Her Britannic

Majesty, the United Kingdom of Great Britain and Northern Ireland". On our side, therefore, the territorial application of the Treaty is limited to the metropolitan territory, and does not include any of the dependent territories.
