Paragraph 7: Compensation under item 6 or 7
Lands
of Part I of the Schedule shall be reduced, so far as the /
Tribunal considers equitable, where the loss or damage
results only partly from the railway.
Paragraph 8: Loss of the benefit of advertising
is not to be compensated under item 9(c).
Paragraph 9: If land is resumed in respect of
which compensation has at some time in the past been
paid for reduction of value, the amount of such
compensation shall be deducted from the compensation
to be paid for resumption.
Paragraph 10: A mortgagee in possession may
claim on behalf of himself and his mortgagor and shall
hold the compensation as if it were proceeds of a
mortgagee's sale.
Paragraph 11: It is made clear that
compensation under items 1 and 3 may be assessed on the
basis of the Crown Lands Resumption Ordinance even
where that Ordinance would not enable the particular
interest in land to be resumed thereunder.
