Under item 9(a) of Part I of the Schedule

any person owning a compensatable interest in the

building from which is removed any object or structure

which is not illegal, may claim compensation for the

amount by which the open market value of the building

is reduced on account of the removal. Under item 9(b)

any person who removes an object or structure described

above may claim compensation for the cost of doing so.

Under item 9(c) the owner of an object or structure

which was not illegal and which has been forfeited to

the Crown under clause 14(5) may claim compensation

for his loss.

Clause 15: The Building Authority may, where

he is of the opinion that any building works or the

commencement thereof would be incompatible with the

railway, exercise certain discretionary powers in relation

to building plans and the commencement of building works.

For the purposes of sections 23 and 24 of the Buildings

Ordinance anything done contrary to the Building

Authority's decision is to be deemed a contravention

of the Buildings Ordinance.

Under item 10 of Part I of the Schedule the

owner of land affected by the withdrawal of approval to

a plan or consent to the commencement of building

works may claim compensation for certain losses sustained

by him on account of such withdrawal.

Clause 16: The Buildings Ordinance is not

to apply to any building works which are carried out under

powers conferred by this Bill.
