Honourable Members will recall that, when proposals for exploring sources of finance, letting contracts and establishing operational arrangements for the Mass Transit Railway project were put to them on 23rd May 1972, they were informed that legislation providing for the compulsory acquisition of property and for creating rights of way would be required. The following is an extract from the relevant Executive Council memorandum XCC(72)73;

"21

In order that all aspects of the work are kept in phase with each other, the early enactment of legislation will be necessary to provide for the compulsory acquisition of property, the alteration of streets and the compensation of those whose property will be interfered with; otherwise construction might be delayed due to the time needed to acquire property. The drafting of this legislation would also be proceeded with over the coming months and would be supervised by the steering group referred to in paragraph 15 above.

Members advised and the Governor accordingly ordered:

"(e) that draft legislation be prepared as soon as possible for the compulsory acquisition of, and compensation for, property affected by the construction of the Mass Transit Railway.

The Mass Transit Railway (Land Resumption and Related Provisions) Bill 1974, annexed, incorporates in one enactment:

(a) all the statutory powers required in the course

of building the Mass Transit Railway, including the power to resume land and create easements;

and

(b) provision for compensating for loss or damage arising from the exercise of these powers.
