EXECUTIVE COUNCIL DECISION OF 15.1.74

The Council considered memorandum XCC(74)4.

The Council ADVISED and the Governor ORDERED:

that the Prevention of Bribery (Amendment) Bill 1974 be introduced into the Legislative Council subject to:

(a) consideration being given to the amendment

of clause 7 to provide that a notice by the Commissioner under new section 14A shall be valid for a period of twelve months only, without prejudice to the issue of a further notice; and

(b) an amendment to the proposed section 12(3) in clause 4 to

make it clear that a convicted person may be ordered to pay to the Crown an amount equal to unexplained resources, whether or not the actual resources which were not explained.
