APPOINTMENT OF FUISNE JUDGE, HONG KONG
1.
Please see Hong Kong's reply (their telno 212) to our telno 113.
2. I have discussed this with Mr Stuart who thinks that we should now agree with the Governor's recommendation that Mr Baber should be appointed to the vacant post of Fuisne Judge. The creation of a Court of Appeal will create an additional post in the Supreme Court which would leave open the possibility of an appointment from this country (paragraph 3 of our telno 113).
3. If you agree I should be grateful if you could pass the file to Sir George Dure in the Recruitment Executive ODA for the processing of Mr Baber's promotion.

In his telegram 212 the Governor also asks us to confirm that we have no objection to his proposal that a permanent Court of Appeal should be established. I should be grateful for your advice on whether we can agree to this proposal are the details provided in paragraph 4 of Hong Kong telno 212 a sufficient basis for us to take a decision?
