Our impression from your despatch of

7 January was that the vacancy was consequential on the

appointment of one of the Puisne Judges to be Senior

Puisne Judge.

2.

We take it, however, from your telegram under

reference that you are now in effect creating an extra post

of Puisne Judge in addition to the vacant post of Senior

Puisne Judge. We can agree to the appointment of Baber on

that basis. This is on the understanding that, as

foreshadowed in your para. 3, the possibility of an

outsider will be considered next time round.
