Proposal

No special pension. Such persons would be appointed on agreement with usual gratuity at the end of a notional 21 year tour. This is considered entirely adequate.

No change. If unifying of salary is desirable, Chief Justice's policy of requiring "older" candidates for appoint- ment as magistrate will produce generalfy uniform salary on the Master Pay Scale for magistrates, having regard to grant of increments for professional experience beyond minimum. Fixed salary at a high level is neither practical nor acceptable.

EXPERIENCE

OF CIVIL WORK.

Experience of civil work for prospective

District Judges.

Magistrates have no civil juris- diction. Such as they had has been taken away in recent years.

No change in the jurisdiction of magis- trates. Chief Justice's policy is that magistrates and others who are likely to be appointed to the District Court should have experience in the Supreme Court Registry beforehand - thus providing some experience of civil matters. Chief Justice does not favour a civil juris- diction for magistrates. It is the Government's policy that changes in relation to smaller civil matters must be in the direction of the new labour tribunal and the proposed small claims tribunal where proceedings are informal and conducted in the Chinese language.
