I accordingly submit a draft letter covering a slightly
bowdlerised version of Sir V Evans minute. This does not attempt
to deal with all the questions raised by Lord Gardiner or in the
Governor's reply. In particular we are dealing separately with
the style of address of district judges and with mandatory
sentences. The account of the state of business in the courts
to which the Governor refers in para. 13 of his telegram no. 67
(Mr Hobley's letter to me of 21 January) does indeed disclose a
relatively satisfactory state of affairs. But does not entirely
dispose of the complaints against the district court and the
extension of its powers. Indeed it goes a long way to show
that the extension was not necessary. The Department's legal
adviser has agreed to the draft letter.
