Thank you for your letter of 26 April reference SCR 49/2091/73.

We have now received a further enquiry from Amnesty International concerning the general position of the Hong Kong Government towards South Vietnamese "draft dodgers" and "deserters". This arose from a telephone enquiry from Mr Cheng Huan. I asked him to put this in writing. I enclose a copy of his letter, together with my interim reply.

The first and second questions may be relatively easy to answer. The third is a policy question to which the second half of your letter refers. We still have to obtain Ministers' views both on the case of Ly Han, and on the general question of repatriation. In doing so we will ensure that the views in the penultimate paragraph of your letter are taken fully into consideration. It may be that a full reply to Mr Cheng Huan will have to await this review. But it occurs to me that you might be able to give a definitive reply at least on those who have valid visas for other countries. This was the case with Leung Pak-kin, and if we can dispose of these instances now, it would at least narrow the area of potential dispute.
