MP'S LETTER: MR ALAN ELLIS

Problem

1.

Sir Anthony Royle MP wrote to Lord Goronwy-Roberts on 5 December enclosing a statement (dated 2 December) which he

had received from his constituent, Mr Alan Ellis. Sir Anthony asks that the statement be forwarded to Mr Cater, the Commissioner of the Independent Commission Against Corruption (ICAC), with

a request that the Commission should investigate Mr Ellis's

case.

Background

I set out the background to this case in my submission of 6 May. In his letter of 9 May Lord Goronwy-Roberts told Sir Anthony Royle that Mr Cater had confirmed that the Commission would look at Mr Ellis's case if there was "fresh and conclusive evidence of corruption". He added that the Commission could not concern itself with any administrative aspects of the case.

Mr Ellis's statement of 2 December does not attempt to go over the administrative aspects of his complaint. In line with Mr Cater's requirements, it is mainly concerned to present his allegations of corruption. However, although these allegations are now set out in an orderly manner, it must be for Mr Cater to judge whether there is anything new in Mr Ellis's presentation. He will probably judge that there is not. But since he agreed both personally to Sir A Royle and through the Governor, in the latter's letter to me of 11 April, to look at the corruption aspects of the case once again, I think we must ask him to do so. Mr Ellis is a persistent gentleman with a sense of grievance. He will not let the matter drop unless he is satisfied that it has received the most thorough investigation, and probably not even then. I have written accordingly to Mr Cater.
