ALLEGATIONS RECEIVED BY THE COLONIAL SECRETARIAT OR AT GOVERNMENT HOUSE

Allegations received by the Colonial Secretariat or at Government House must be referred to the Secretary for the Civil Service who will forward them to the Director of Operations of the Independent Commission Against Corruption or the Attorney General as the case may be. Allegations will not be referred to other parties who may be concerned.
OPERATIONS TARGET COMMITTEE

Allegations referred to the Independent Commission Against Corruption or received by the Commission direct will be submitted to the Operations Target Committee. This Committee advises whether allegations are to be investigated and what priority is to be given to the investigation.

If an investigation is to be undertaken, the Secretary for the Civil Service will be informed. At the conclusion of the investigation, the Secretary for the Civil Service will be advised of the outcome and any action taken by the Commission.

If the Operations Target Committee advises that no investigation should be undertaken, or if the investigation does not result in a criminal conviction, the Director of Operations will submit a detailed report on the case to the Secretary for the Civil Service.
This report will contain a recommendation on whether or not disciplinary action ought to be instituted against the person or persons concerned. The Secretary for the Civil Service will then decide, after consultation with the Head of department concerned, whether or not disciplinary proceedings should be instituted. The Secretary for the Civil Service will notify the Commission of the action, if any, taken against the officer or officers concerned.

Heads of Departments are reminded that whilst action by the Independent Commission Against Corruption is essential in detecting and prosecuting offenders, the battle against corruption cannot be won unless preventive action is taken to eliminate opportunities for corruption. It is important that departments maintain a continuous watch over their procedures and take all reasonable precautions to block openings for corruption. The Corruption Prevention Branch of the Independent Commission Against Corruption is available to assist departments in this task.
