(i) the rebuilding by the Government of his hut;
(ii) the return of the $850 allegedly stolen;
(iii) compensation in cash for loss of livelihood and
expenses since the demolition, as he can no longer run his farm;
(iv) compensation for branding him as a criminal by
having him arrested and forced to take treatment at Castle Peak Hospital; and
(v) assurance that such a thing would never happen
again.
Previous papers on the case were again reviewed in the Secretariat and the District Commissioner, New Territories, was asked whether it would be possible for permission to be given to Mr Lui Sung to re-erect his kitchen on the condition that the total ground floor area of the house and kitchen did not exceed 400 sq ft. The District Commissioner was also asked whether written notice of the intention to demolish the kitchen had been given.
An acknowledgement was sent to Firs Elliott on the 5th November 1973 saying that Mr Lui's case had been the subject of exhaustive investigation in the past and that it seemed doubtful that anything further could be done. However, certain clarification was being sought from the District Commissioner, New Territories, and that she would be advised further when his reply was received.
Mrs Elliott wrote on the 28th November 1973 asking whether there was any further information which she could give to lir Lui. A letter was written to Mrs Elliott on the 3rd Decerber 1973 saying that a further letter would be sent to her when the reply from the District Commissioner, New Territories had been received.
The reply of the District Commissioner, New Territories, confirmed previous findings and reported that Mr Lui Sung's buildings, including a kitchen, totalled 435 sq ft in floor area, ie the position was that Mr Lui Sung had a house which had not been demolished (but in the roof of which holes had allegedly been bored) and a kitchen which Ir Lui had unlawfully re-erected after the original structure had been demolished on the 23rd March 1972. The District Commissioner, New Territories, confirmed that prior to the demolition of the original kitchen Mr Lui had received written notice that unless the original kitchen could be shown to be legal it would be demolished after two days: in fact ten days elapsed before demolition.
