1. Mr Johnson forwarded to the Secretary of State a copy of a letter from Mrs Elsie Elliott about a
Mr Lui Sung. We asked Hong Kong for their comments and for the background to the case. These have now been received by saving telegram.
2. Mr Davies (APS to Mr Blaker) has asked if the report on the case, which is quite long, could be included as an enclosure to Mr Blaker's reply to Mr Johnson. He also said that he did not think that Mr Blaker should reply direct to Mrs Elliott and that we should ask the Governor to reply on Mr Blaker's behalf.
3. In the draft of the report to be enclosed with Mr Blaker's reply to Mr Johnson, I have omitted those paragraphs (nos 3, 17, 19, 20, 21) in the Hong Kong telegram which are "comment" rather than the "facts" of the case. I think that the report shows that the Hong Kong Government acted within the law in pulling down Mr Lui's kitchen. There is no evidence to substantiate Mr Lui's claims that money was stolen from a drawer or that an attempt at bribery was made. However, one point where the Government is open to criticism is that the hut was demolished when neither of the parents were present (paragraph 2 of the saving telegram - at the top of page 2). This is one of the accusations made by
Mrs Elliott and one which she says has not been answered by the Colonial Secretary. I think it would be as well not to deny this and I have left this passage in the draft report.
4. I think it worth emphasising in the reply to Mr Johnson that it is only the kitchen that was
demolished and not the entire hut, as Mrs Elliott infers in her letter.
5. I attach a draft submission covering a draft reply to Mr Johnson MP. I also attach a draft letter to the Colonial Secretary for Mr Stuart's signature, asking the Governor to reply on behalf of Mr Blaker.
