this he heard somebody shout out "Robbery" and that he became

frightened and ran away because he realised, apparently for the

first time, that a robbery was taking place. He said that he was

overtaken by the prisoner and his co-accused and they all went back

to the prisoner's flat, and he said that back at the flat he saw

that the prisoner had blood on his underpants and he said he

remembered that the prisoner had said that he had hacked somebody.

The victim of the second and third charges, Mr. CHEUNG Kwong-ping,

the husband of the deceased, gave evidence that he and his wife used to manage the Wa Nam Apartment House and that on the night of the 23rd/

24th August, 1973 there was one room which was not let and that during

the early hours of the 24th August, the door bell rang and one young man appeared at the door wanting to book a room. Mr. Cheung described

how he opened the door of the apartment house and then the iron grille

whereupon the young man whom ho said was about 20 years of age suddenly

took out a knife and told him not to move and that this young man then called out to someone else to come up. Mr. Cheung said that he pushed

this first young man away but in doing so he fell down, and it was then

he saw his wife come out of the apartment house and that this first

young man stabbed her once with a knife (forensic evidence showed that

the deceased had died due to a stab wound in the throat.) He said that

he went up to his wife to assist her and at this time he noticed another

person had arrived and while he was trying to assist his wife ho said

that other person stabbed him. He said that he must have been stabbed

with a knife because of his wound (again medical evidence showed a stab wound in Mr. Cheung's abdomen which in the doctor's opinion was probably caused by a sharp instrument such as a knife.) Mr. Cheung said that he only saw two men in all during this incident. He said he was quite certain that there was no third person present, that is

other than his wife. He said that in the confusion he could not

identify either of the assailants.

After his arrest the prisoner made a statement after caution in which he admitted going to the apartment house intending to commit a robbery. He said that he and his co-accused and WONG Pang-yuk went up to the front door of the apartment house together, that he rang the
