That your petitioner was convicted of murder and was sentenced to death on the 9th January, 1974. His application for leave to appeal against conviction

was dismissed on the Sth March, 1974. He now wishes to petition His Excellency to have his death sentence pardoned.

Your petitioner was born in Hong Kong in 1953, his parents have 9 children, and are now too old to work. One of his 2 elder brothers has already married, while the other one is physically handicapped. His eldest sister is also married. One of his younger sisters and his 2 younger brothers are still at school: The burden of supporting the whole family of eleven falls automatically upon your petitioner, and 2 other younger sisters.

Your petitioner was brought up in a poor family and because of financial hardships, he had to go out to work after leaving primary school. He has been faithful to his job ever since and has no bad interests whatsoever.

In the evening of the 19th July, 1975, the day of the incident, your petitioner went for a walk. On his way, he came across several friends who invited him to accompany them to look for some other guys in an apartment in Hong Kong. Since your petitioner had nothing to do then, he followed them to the apartment. He didn't know the owner of the apartment; he, therefore, stayed outside the door to wait for his friends who talked with a few men whom he didn't know either. It was not long before they started a quarrel and then a fight. Since he did not know what they were fighting for he rushed to them in an attempt to stop them.

Your petitioner did not have any knowledge of the reason for the dispute and did leave the spot when someone attempted to assault him. He did not know what happened after he had left the place either. That is to say, he is not responsible for the murder. He had told the judge during hearing in the Supreme Court, but was still found guilty. He, therefore, sincerely craves His Excellency to carefully consider his petition and grant him a pardon so that he is able to turn a new lease of life.
