CIRCUMSTANCES

Gang killing. Group of young men armed with sticks attacked members of rival gang in revenge for attack on one of their friends boy of 14 died from fracture of skull.

REASONS FOR COMMUTATION

Age of accused. No evidence as to who struck blow that

killed boy. Use of sticks suggests intent to injure rather than to kill. Judge recommended reprieve.

Gang fight. Accused and three others armed themselves with knives and chopers. Attacked two young men who had annoyed them in manner involving loss of face.

Ho and another man attacked Police Officer with object of taking his revolver. During struggle Ho shot Constable.

Over four years between murder and trial due to Ho's flight to China. His accomplice only got 6 years. Ho, a man with low mentality, probably misled by other man who was hard-core

communist. Attack could be said to have been part of confront- ation struggle.
