CAPITAL PUNISHMENT

There are four current capital cases in the Dependent Territories, apart from Hong Kong.

1. Belize

An appeal is due to be heard at the session to be held at the session to be held from 19-28 February 1974. If the appeal is dismissed the case will be considered by the Committee for the Prerogative of Mercy shortly after.

2.

Bermuda

There is a current case which will have to go to the Magistrates' court in the first instance, and if a Magistrate finds there is a case to answer, the accused will be committed for trial in the Supreme Court. It is likely to be several months, therefore, before this case goes to trial.

3. Cayman Islands

There was a case before the Courts in December over which the Jury were in deadlock. They were subsequently dismissed and a new trial is expected any time now.

4. Montserrat

A High Court Judge dropped dead shortly after sentencing two people to death, but before he had been able to make his report to the Governor. On appeal, one conviction was quashed. The Governor consulted FCO officials and Legal Advisers over the other case and we are waiting to hear his decision.
