ARTICLE 7(c)
There are no legislative or other obstacles to prevent equal opportunity for promotion for all based on seniority and competence.
ARTICLE 7(a)
Under the Factories and Industrial Undertakings Ordinance working hours in industrial employment are limited by law only for women and young persons, who may not be employed for more than 43 hours and six days in a week and must be allowed certain rest periods during each work day. Under the Employment Ordinance six statutory holidays with pay are prescribed for all manual workers and those non-manual workers earning HK$2,000 (approximately US$400) or less a month subject to certain qualifications of service. They are also entitled to four rest days a month and those paid on a monthly basis are granted wages ch their rest days. In the commercial sector most employees are granted holidays in accordance with the Holidays Ordinance which provides seventeen holidays
a year.
ARTICLE 8
The Trade Unions Ordinance is designed to prevent abuse of trade unions, to ensure that they are administered constitutionally and thus afford protection to their members.
1(a)
The Employment (Amendment) (No. 2) Ordinance 1974 gives effect to certain provisions of I.L.0. Convention No. 98 (Rights to Organize and Collective Bargaining Convention, 1949). The following rights are conferred on employees:
(a) the right to become a member or an officer of a
registered trade union;
(b)
(c)
the right to take part at any appropriate time in its activities; and
the right to associate with other persons for the purpose of forming and registering a trade union.
The Ordinance also makes it an offence to include in an offer of employment to a person a condition or requirement that he will undertake to relinquish his membership of a trade union,
