In my opinion, if section 68 of the Education Ordinance is to

be firmly and effectively applied to communist schools, it is essential

that it should be applied equally to other schools registered under the

Education Ordinance. This consideration was amongst those that I took

into account in reaching a decision on the application in respect of Miss

FUNG.

I do not regard the matter of referee letters as having any direct

bearing on the point at issue. Referees may comment usefully on the

character or professional competence of the person concerned, but

refusal of a permit under section 68(1) does not, in my opinion, imply

any imputation as to character or professional competence. Such refusal

is based on an objective assessment of the educational environment of the

to employ a person as a permitted teacher in a school may only be made

if the applicant is of the opinion that no suitable registered teacher is

available for employment as a teacher in the school. I have no knowledge

Catherine's School for Girls, Kwun Tong, to find a suitable registered
