of the termination of his services. He shall have no further claim on the Government.
(iv) In accordance with the provisions of the Hong Kong
Pensions Ordinance (Cap.89) an officer who has been confirmed to (or is on probation to) the pensionable establishment may be invalided from the service on receipt of medical evidence that the officer is in- capable by reason of any infirmity of mind or body of discharging the duties of his office and that such infirmity is likely to be permanent. Such an officer's service is not usually terminated on account of ill- health if there is a definite prospect of his being able to perform his duties satisfactorily within a reasonable period of time after receiving medical treatment, and being granted sick leave in accordance with Establishment Regulations.
17. DISMISSAL OR PUNISHMENT FOR MISCONDUCT, ETC.
Pensionable and probationary officers
(i)
An officer who has been confirmed to (or is on probation to) the pensionable establishment may be dismissed for misconduct, On dismissal, such an officer forfeits all rights and advantages of his appointment, and no retiring benefits are granted to him.
(ii) Officers on agreement
If an officer on agreement at any time neglects or refuses or for any reason (except ill-health not caused by his misconduct) becomes unable to perform any of his duties or to comply with any order, or shall disclose any information concerning the affairs of the Hong Kong Government to any unauthorised persons, or in any manner misconduct himself, he may be dis- missed and on such dismissal all rights and advant- ages of his appointment shall cease, and he shall be liable to repay on demand to the wovernment that proportion of the cost of passages to Hong Kong (including associated baggage and travelling expenses) provided in that tour for himself and his family which the uncompleted portion of the full tour bears to the full tour, and the outstanding balance of any recoverable advances of salary which he may have received.
(N.B. It is to be particularly noted that any officer who is dismisscd will thereupon cease to be eligible for passage to his country of origin).
(iii) All officers
Any officer may be punished for misconduct in accordance with the provisions of Colonial Regul- ations, Part I, Appendix II, Colonial Regulations 56 and 57, or Establishment (Disciplinary) Regul- ations 5 to 8.
18. DEATH OF Officer
(i)
If an officer dies in service, his family will be granted passages to his country of origin. Such passages are available for six months after the date of the officer's death.
