Holidays with Pay

The Employment (Amendment) (No. 2) Ordinance 1973 which repealed and replaced the original Industrial Employment (Holidays with Pay and Sickness Allowance) Ordinance provides as from 1st July 1973 for entitlement of one paid sickness day on half pay for each completed month's service; and as from 1st January 1974, an entitle- ment to six annual statutory holidays with pay for all employees covered under the Employment Ordinance, Chapter 57. Paid sickness days can be accumulated up to 24 days. The qualifying criteria for holiday pay

and sickness allowance have also been reduced and simplified. At present consideration is being given to the provision of additional statutory holidays..

The Holidays Ordinance, Chapter 149, prescribes 17 general holidays in a year. Most commercial concerns (other than some retail shops) and all banks, grant these holidays to their employees.

Under Part III of the Employment Ordinance, a female employee who has worked for the same employer under a continuous contract for a period of not less than 26 weeks is entitled to maternity leave. same part of the Employment Ordinance, no employer shall terminate a contract of employment of a female employce by notice or by payment in lieu of notice (in accordance with sections 6 and 7 respectively) during the period from the date on which the female employee serves notice to her employer concerning her maternity leave. to the date when her maternity leave expires. Certain large establishments operated on western 'lines grant maternity leave to female employees on a half-pay, or sometimes full-pay basis.

As far as the general education of workers in Hong Kong is concerned, the policy is to give priority to industrial and vocational' training. In view of these priorities, it is not expected that Hong Kong will in the foreseeable future be able to grant all workers individual rights to paid educational leave.
