Amendment of section 4. (Cap. 220.)
Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.
1.
(1) This Ordinance may be cited as the Road Traffic (Amendment) (No. 3) Ordinance 1974.
(2) Sections 2, 3(b) and 4 shall come into operation on the day appointed for the commencement of the Fixed Penalty (Criminal Proceedings) Ordinance 1974.
(3) Section 3(a) shall come into operation on a day to be appointed by the Governor by notice in the Gazette.
2. Section 4 of the principal Ordinance is amended by inserting, after subsection (4), the following new subsection-
"(5) In any proceedings under any Ordinance, a certificate purporting to be signed by or on behalf of the Commissioner or the Commissioner of Police and stating any particulars in the register of motor vehicles maintained by the Commis- sioner in accordance with regulations made under this Ordin- ance shall be admitted in evidence on its production without further proof and—
(a) until the contrary is proved, it shall be presumed
that the certificate is so signed; and
(b) the certificate shall be prima facie evidence of the
facts stated therein.".
