EMPLOYMENT (AMENDMENT) (NO.3) BILL 1974

1. Please see the Exco memorandum at folio ll below.

2. In his letter LA 393 of 29 April Mr Foggon informed Hong Kong that Mr Valticos, Chief of the International Labour Standards Department of the ILO had expressed a view that two further provisions would have to be incorporated into the proposed legislation to enable Convention No. 98 to be applied to Hong Kong without modification. My reading of the revised draft of the Bill is that it includes the provision to meet the point raised on article I of the Convention but nothing on the suggested improvement to Article II.

3. However it seems that if the draft bill, as amended by paragraph 2 of the memorandum, was accepted by ExCo Hong Kong will presumably now be able to go ahead and ratify IL Convention No. 98 without modification (we should have the minutes of the ExCo meeting of 2 July in about two weeks time).
