At Annex A for the consideration of Honourable Members. is the Labour Tribunal (Amendment) Bill 1974, the main purpose of which is to establish the Labour Tribunal on a permanent basis.

Background

The Labour Tribunal Ordinance (Chapter 25), which was enacted on 29th March 1972, provided for the establishment of a Labour Tribunal with a simple and informal procedure for settling monetary claims arising from the relationship of employer and employee (memoranda XCC(70)56 (Annex B) and XCC(72)7 (Annex C)). It was introduced on an experimental basis and is due to expire on 31st December 1975,

Operation of the Tribunal

The first Labour Tribunal commenced operation on 1st March 1973. It proved to be an immediate success. 1144 cases were dealt with in the first year of its operation. This figure doubles the original estimate of 500 claims a year and equals the annual figure of all wage cases handled by the District Court in previous years, The tribunal has succeeded in dealing with these cases quickly and in a simple, informal and inexpensive manner; the time taken to settle a case is between two and three weeks. To enable the tribunal to keep up with its increasing volume of work, it has been necessary to appoint a second presiding officer and supporting staff with effect from 1st February 1974.

Ordinance to be permanent

It is concluded, on the basis of its performance over the past twelve months, that the tribunal does serve a very useful purpose and should now be made permanent. The proposed bill is designed to give effect to this intention by repealing section 47 of the Ordinance (clause 12) and at the same time to make some minor amendments in respect of the legal procedures applicable to the tribunal.
