It is considered that the public would welcome a new procedure along the lines suggested as a positive approach by the Government towards tackling the problem of unresolved minor claims. Publicity should emphasise the separate and distinct character of the Tribunal which distinguishes it from existing District Court procedure. This should be eased by providing that both the name of the Tribunal and of its officers should be described in Chinese, as well as in English, in the legislationi

The Chief Justice supports the establishment of the proposed Tribunal subject to his views on the level of the post of Adjudicator referred to in paragraph 15. The Law Society and the Bar Association have been consulted and they are also in favour of the proposal.

Honourable Members will be asked to advise whether legislation should be drafted and submitted for the approval of Honourable Members prior to its introduction into the Legislative Council, providing for the establishment of a District Court Small Claims Tribunal on the general lines recommended in this memorandum, subject to the provision of the necessary funds by the Finance Committee of the Legislative Council.
