Your letters of 11th February and 4th March to the Economic Intelligence Department have been referred to the Treasury who have not yet formed a view on how the breaches of MSP in December and January should be treated. the terms for dealing with accidental breaches which are set out in FCO telegram 1209 of 26th November 1973.

They clearly go beyond

It is unlikely that a decision will be taken on whether Hong Kong can be regarded as having fulfilled the terms of the Declaration until all the returns are in, but there would obviously be great difficulty if it turned out that the terms of the Declaration had not been met on other occasions besides these two.
