MASS TRANSIT STEERING GROUP

Procedure to be adopted following Receipt

of a Pre-emptive Bid

Consortium delivers bid (receipt of which cannot be acknowledged before 1st October 1973).

Steering Group acknowledges receipt of bid and examines its validity in terms of the Government's requirements.

If the bid is considered valid, then the Steering Group:

(a)

(b)

informs the consortium that their bid is considered valid; and

notifies the other consortia of the receipt of a valid bid, which may be accepted after 30 days have elapsed.

Steering Group awaits reactions, if any, from the other consortia.

(a) IF no other consortium puts in a counter-bid, the Steering

Group to seek the advice of Executive Council as to whether the bid should be accepted.

(b)

IF one or more of the other consortia put in a counter-bid or counter-bids within the 30-day period (see pra. 3(b) above), then the Steering Group:

(i) notifies all bidders of receipt of counter bid(s);

(ii)

(iii)

confirms to all bidders, within a further 14 days of the expiry of the 30-day period, whether the counter-bid(s) is/are valid in terms of the Government's requirements; and

if there are two or more valid bids, and it is not possible to choose between them straight away, then opens up competitive negotiations with the bidders.

Footnote:

It was subsequently agreed by the Steering Group with the consortia that there was no question of counter-bids being "validated" in terms of the Government's require- ments, but simply that it should be couched in terms which were sufficiently specific for the purposes of being compared with the pre-emptive bid.
