1. We have now to send the Governor our final comments

the proposals in the Blair-Kerr Report. The Hong Kong

Attorney-General will announce the Government's firm proposals

when he speaks in the Legislative Council on 14 or 15 November.

2. The points at issue are discussed in my submission of

15 October. We have since discussed the main outstanding

questions with Mr Royle. These are:-

(a) Whether we can amend the Fugitive Offenders Act

(paras 2 3 of Hong Kong tel 1180);

(b) Whether a change should be made in Colonial Regu-

lation 62 governing disciplinary charges against

an officer who has been acquitted in court (paras

5-7 of Hong Kong tel 1180);

(c) Whether we agree to the extension of Section 10

of the Frevention of Bribery Ordinance to cover

the property of others than the accused (para 12

of Hong Kong tel 1180).

The only other outstanding point is a proposal to amend the

Pensions Ordinance (para 10 of Hong Kong tel 1180).

3. We have already told the Governor that we cannot change

the Fugitive Offenders Act to catch Mr Godber, but that we

are examining the possibility of a change on general grounds

(FCO tel No 1031). No further comment is required for the

time being.
