LETTER TO MR ROYLE FROM MR ALAN ELLIS

1. Mr Royle's constituent Mr Alan Ellis has written to him

yet again raising both the question of an externally appointed

judicial commission of enquiry into corruption in Hong Kong,

and his own individual case. In the second paragraph of his

letter Mr Ellis refers to a meeting which he had with Mr Macoun

on 2 July and also to points raised by him in his earlier letter

of 22 May.

At that time it was decided that Mr Ellis's letter

of 22 May did not call for a reply and was dealt with by the

offer of the meeting with Mr Macoun. The record of Mr Macoun's

talks with Mr Ellis on 2 July is attached.

I attach a draft reply to Mr Ellis. The department's legal

adviser and Mr Macoun concur.

3. The Establishment Regulation No 303 referred to by Mr Ellis

concerns officers on probation. The Blair-Kerr Report

recommended that grounds for not confirming an officer on to

the pensionable establishment should not be confined to:

"general unsuitability of temperament, personal characteristics,

misconduct or the inefficient performance of his duties" but

that suspicion of corruption should also be grounds (paragraphs

194 - 195 of the Report). Blair-Kerr therefore recommended

amendment or revocation of the provision. We commented that

if an officer is corrupt then his personal characteristics are
