1. I have spoken to Mr Royle. He himself has spoken to Mr Carlisle, Minister of State at the Home Office. Mr Carlisle nas confirmed his officials' view that the Home Office could not ask the police to conduct a surveillance on Godber. He has, however, said that he would have no objection to our referring to this refusal if we had to defend in public our decision to allow Hong Kong to appoint a Private Detective Agency to watch Godber.

2. Hong Kong will therefore have to proceed with their plans to appoint an Agency. I have told Mr Grattan about this. He is informing Mr Acland in Ottawa. While he still has reservations about Hong Kong taking this step he regards as important the fact that the Attorney-General did not raise any objections to it.

3. I attach a copy of your draft submission to Mr Grattan to which I have made a few amendments.

I am sending a draft telegram "Personal to the Governor from Mr Royle", telling the Governor that Mr Royle has spoken to Mr Carlisle about surveillance by local police here and giving him Mr Carlisle's reply.asking the Government not to publicise the fact but to use it only if the news of the hiring of a private agency becomes known
