CHIEF SUFERINTENDENT GODBER

1.

We have now received the first part of Sir A Blair Kerr's

report to supplement the Governor's telegram No 722, on the

reasons why Mr Godber was able to leave Hong Kong.

2. The report records that Mr Godber had HK$ 4.3 million,

for which no explanation has been offered. If he had remained

in Hong Kong he would certainly have been charged under

Section 10 of the Prevention of Bribery Ordinance as being in

control of pecuniary resources disproportionate to his

official emoluments. According to the report he was able to

escape partly because, for acceptable reasons, he was not put

under surveillance or interdiction, and did not have his

airport pass, warrant card, or passport withdrawn; but mostly

because Section 10(2) of the Ordinance required him to be

given time to explain himself, and in that time he escaped.

The Governor has now asked whether we see objection to the

publication of the report; to the repeal of Section 10(2) and

the associated Section 10(4); and to a new provision to make

it possible to withdraw a suspect's travel documents. He has

asked for a reply before the night of 16 July our time.

Presumably the reason for wanting to publish the report

is its conclusion that fir Godber did not receive assistance
