HONG KONG : PREVENTION OF BRIBERY ORDINANCE

1. Please refer to your letter 14/2/184 of 23 September/about the Bill for this Ordinance.

As a result of action taken under S. 10(2) of the Ordinance a Hong Kong police officer suspected of having ill-gotten gains of some 4.3 million Hong Kong dollars absconded recently from Hong Kong.

The Governor appointed a judge to enquire into the circumstances of his leaving Hong Kong and we now have his report.

4. Among other things, the judge has recommended repeal of sections 10(2) and (4) of the Ordinance and, in reply to a telegraphic request for comment from the Governor on this recommendation, we telegraphed our views to Hong Kong last Friday. Copies of the two telegrams are enclosed.

5. Mr Royle, having authorised the issue of our telegram, has asked whether the Attorney would wish to dissent from the assessment in paragraph 2 of our telegram.
