DEATH SENTENCE PASSED ON WONG YU-HUNG

On 14th February 1972 WONG Yu-hung was convicted of the murder of EO Kam-wa and was sentenced to death. The report by the Honourable Mr Justice Cons, the trial transcript, and the judge's summing-up have already been circulated to Honourable Members. Honourable Members may wish to study again the trial judge's report at Annex A.

An appeal by WONG against conviction was dismissed by the Full Court on 29th March 1973. A copy of the judgment of the Full Court is at Annex 3.

Petitions for clemency have been submitted by WONG (Annex C), by the late Bishop Francis Esu (Annex D) and by Father D. Martin (Annex E).

Also annexed are a report by the Secretary for Home Affairs (Aknex F), a report by a Probation Officer (Annex G) and a Police antecedent statement (Annex H).

Honourable Members will be asked to advise whether the law should take its course or whether the sentence passed on WONG Yu-hung should be commuted. (If His Excellency decides that the sentence should be commuted, Honourable Members will be asked to advise on the sentence of imprisonment which should be substituted for the death sentence).
