DEATH SENTENCE PASSED ON LEUNG PING-FAT

On 22nd January 1973 LEUNG Ping-fat was convicted of the murder of KWOK Chiu and was sentenced to death.
The report
by the Honourable Mr Justice P. F. X. Leonard, the trial transcript,
Honourable and the judge's summing up have already been circulated, Members may wish to study again the trial judge's report at Annex A.

An appeal by Leung against conviction was dismissed by the Full Court on 9th May 1973. A copy of the judgment of the Full Court is at Annex B. His subsequent application for leave to appeal to the Privy Council was dismissed on 24th October 1973.

A petition for clemency submitted on Leung's behalf by his solicitors is at Annex C.

Also annexed are a report by the District Commissioner, New Territories (Annex D), a report by the Probation Officer (Annex E) and a police antecedent statement (Annex F).

Honourable Members will be asked to advise whether the law should take its course or whether the sentence passed on LEUNG Ping-fat should be commuted, (If His Excellency decides that the sentence should be commuted, Honourable Members will be asked to advise on the sentence of imprisonment which should be substituted for the death sentence).
