even if a lesser one, I would hope that when he informed us of
his preliminary decision to let the law take its course, he
would still be willing to receive comments from us on the facts
of the case or its surrounding circumstances which might help
him to review his decision. This would lead to delay if he
reaffirmed his original decision, but we should still have
sufficient time to consult Ministers.

I therefore recommend that we should adopt the following
procedure, based on the Governor's proposals:
(a) If the Governor informs us that he has decided to

reprieve, no action.
If he tells us that he has made a preliminary decision
to let the law take its course, the department will
submit to the Secretary of State recommending:
i) further comments to the Governor; or
ii) wait for the papers with a view to further
comments; or
iii) a decision to support the Governor; or
iv) a decision to change the law; or
v) consultations with Ministers.itnot recommendations.
(c) If we decide on i) or ii) above then we should try to

complete the consultations with the Governor within a
week of receiving the papers, with a view to a further
submission recommending iii), iv) or v).
If the recommendation is to support the Governor, the
Secretary of State will wish to decide whether to
