Doomed killer. will appeal

A 23-year-old convicted killer deomed to hang will appeal to the Privy Council after losing his appeal against conviction in the Supreme Court today.

The Full Court upheld a Supreme Court judge's decision that Leung Ping-fat is to hang for killing a coffin shop employee on January 3 last

year.

Defence counsel Patrick Fung said after the decision that Leung will appeal to the Privy Council.

Leung and two others were changed with murdering Kwok Chiu, 47, an employee of the Ho Fak Coffin Shop in Dundas Street last year.

The other men were acquitted.

Mr Justice Leonard sentenced Leung to hang on January 22 this year after a jury returned the guilty verdict.

Resisted

Leung was among the four men, armed with knives who broke into the coffin shop to commit robbery.

Tehy were confronted by Kwok, who was sleeping in the shop at the time but woke up when he heard a noise.

Kwok resisted. grabbed Leung's necktie in an attempt to hold him but Leung cut off the tie and stabbed Kwok five times.

Kwok died of the wounds, but was still holding the tie as he colladsed. It was the tie that led to Leung's arrest.

Leung claimed self-defence but the Full Court agreed with the trial judge that there was "no remote possibility of this" because they believed Kwok had no murderous intention at the time.

They said Kwok was only trying was only trying to hold on to Leung. The Full Court comprised of Mr Justice A.A. Huggins, Mr Justice A. M. McMullin and Mr Justice W.F. Pickering.
