1. As a man's life is at stake I believe that every proper and

constitutional step should be followed to ensure that there is

no possibility of a mistake. I therefore feel that you would be

justified in asking for a psychiatric investigation at this stage

as suggested in paragraph 4 of Mr Stuart's submission.

2. The Governor clearly considers (Hong Kong telegram No 490)

that he can accept and indeed would wish to see a reprieve if a

political row is likely to take place as a result of an execution

in Hong Kong. I share the Governor's view that such a row would

be damaging to Hong Kong's image in other spheres.

THE WIDER POLITICAL ASPECT

3. In view of the Irish vote and the present composition of

the House of Commons, in my political judgement there would

inevitably be "significant controversy" and possibly a major

parliamentary row, if you decide not to recommend a reprieve.

4. As there have been no executions since 1966 it is possible to

continue the present practice of commutation. If Tsoi is hanged

what would be the position in say three months' time if a similar

case involving a European arose?
