Mr Rushford's Minute of 29 June 1973 raised doubts about the appointment of two new District Judges in Hong Kong. We had mentioned these appointments in reply to Lord Gardiner, the Chairman of Justice.

2. Mr Stuart subsequently wrote to the Colonial Secretary (his letter of 9 July) seeking confirmation as to whether these appointments were in fact planned and, if so, whether members of the Hong Kong Bar were to be appointed. The Attorney-General has now written to sag (his letter of 20 July) that two members of the Hong Kong Bar are being submitted for the two vacancies on the District Court Bench, namely

Mr de Basto QC and Mr Benjamin Liu. We should expect to receive a Despatch recommending these two appointments fairly shortly.

Mr Royle still owes a substantive reply to Peter Rees MP. Mr Rees wrote to him in February about appointments from the Bar to the Bench and Mr Royle sent an interim reply on 9 March. I suggest we await the formal Despatch from Hong Kong before submitting a substantive reply from Mr Royle.
