Andrew Stuart, who has just left on a month's leave, has asked me to write to thank you for your letter to him of 5 July, which he saw before he left.
2. As you will have seen, the Secretary of State replied to Lord Gardiner on 27 June. However, the material enclosed with your letter of 5 July has proved very useful indeed in subsequent discussions with Mr Sargant, the Secretary of Justice. Particularly helpful was the Attorney General's Note. Mr Stuart was able to discuss this with Mr Sargant - and to show him a copy "off the record"-before the full Council of JUSTICE discussed the Hong Kong legislation at a meeting on 18 July.
3. I understand that JUSTICE plan to discuss this again at a further meeting to be held on Friday 24 August when
Mr Jackson-Lipkin will be in the UK on leave. In the meantime, Nr Sargant has asked whether a copy of the Attorney General's Note could be passed to their Hong Kong Branch. We replied that we could not give the authority for this without asking you first.
I should be grateful therefore to know whether we can agree to this request. Alternatively, if you agree that it can be shown to the Hong Kong Branch, you might prefer to pass it to them yourself.
4. I should be grateful if you could let me know one way or the other, before Mr Stuart returns to the Office on 20 August. I believe Mr Sargant will be getting in touch with him again at that time prior to the Justice Council meeting on 24 August.
