1. Further to my minute earlier this afternoon about the "warning" to Mr Roberts, Mr Rushford has reminded me of the concise way in which this was expressed in the minute sent to Sir Duncan Watson on 11 January with Sir Vincent Evans' concurrence. Adapting this form to the draft telegram, the latter would run "Although this would not preclude him for consideration for appointment as Chief Justice, Hong Kong when that post next becomes vacant, he should understand that the question of his suitability for appointment as Chief Justice would then have to be assessed again from every point of view.

Subject to this Mr Rushford concurs in the other comments on the draft and has nothing to add.
