1. I should be grateful if you would inform Denys

Roberts that Depedent Territories Senior Appointments

Board has recommended, and Secretary of State has

approved, his appointment as Colonial Secretary, Hong

Kong, with effect from 1 January 1974, and let me know

whether or not he accepts.

2. It should be pointed out to Roberts that his

appointment as Colonial Secretary would not preclude

hi from consideration for appointment as Chief

Justice Hong Kong when that post next falls vacant,

but he will appreciate that, as Colonial Secretary he

might be involved in some exceptional matter of Government business which could concievably render

his subsequent appointment as Chief Justice

inappropriate because as Colonial Secretary he was

necessarily associated with it virtute officii.
