Amendment of

Section 71 of the principal Ordinance is amended

section 71.

(a)

in paragraph (c) of subsection (1), by deleting

"casts or deposits any dead body, ballast,

rubbish, oil or other substance into such

water without the written permission of the

Director, or"; and

Addition of new sections 71A, 718,

71C and 71D.

(b) by deleting subsection (2).

4. The principal Ordinance is amended by adding,

after section 71, the following new sections

"Discharge of oil into Hong Kong waters.

71A. (1) If any oil or mixture

containing oil is discharged into the

waters of Hong Kong, then the following

shall be guilty of an offence

(a) the person by whom the oil or

mixture containing oil is so

discharged or caused to be

discharged; and

(b) whether or not the person

referred to in paragraph (a) has

been charged with an offence

-

(i) if the discharge is from a

vessel, the owner, master, agent

or charterer of the vessel, unless
