HONG KONG IMMIGRATION ORDINANCE 1971

1. The above Ordinance was enacted by the Governor, with the

advice and consent of the Legislative Council, on 14 October.

Ministerial approval for its enactment was given after the

Governor had agreed to the introduction of certain amendments

during the Bill's passage through the Legislature. The Governor

has now sent the Ordinance to us for notification, in the normal

manner, that Her Majesty's power of disallowance will not be

exercised in respect of it.

2. However, the Ordinance as enacted omits one particular

amendment for which Ministers had asked and to which the

Governor had agreed. This was pointed out to the Governor and

from his reply it appears that he had been under the mistaken impression (due to last minute telegraphic exchanges dealing with other amendments) that Ministers had agreed to withdraw

their request for the amendment in question in response to views

expressed by the Unofficial Members of his Executive Council.

This is not, in fact, the case since we were unaware at the

time that Unofficial Members had expressed any views on the

particular amendment concerned and the matter was not therefore

brought to the notice of Ministers.

3. The amendment concerns the position of citizens of the United Kingdom and Colonies (other than United Kingdom belongers) under those provisions of the Ordinance which relate to removal

and deportation from Hong Kong.
