The Hong Kong circular as drafted does not make its meaning sufficiently clear. I have therefore attempted a redraft which incorporates some changes which will need to be cleared with Hong Kong. These

a. Paragraph 2(a) of Hong Kong's draft appears to expand administratively the categories of United Kingdom citizens to whom the special concessions apply. However, Hong Kong have not got it quite right and from their point of view it is important that they do so. At present the holder of a UK passport issued in the United Kingdom, which does not bear an endorsement that it was issued on behalf of a dependent territory is exempt from UK immigration control even if hế has no other claim to exemption. However, when the Immigration Act 1971 is brought into effect this will no longer be the case. I have therefore amended this paragraph to take account of the new situation which will pertain in the near future, and have also clarified the meaning of "some other territories.

a.
The only major change is the inclusion of a paragraph on the dependants of resident United Kingdom belongers. I am not convinced that Mr Gaminara's argument (in para 2(b) of his minute) that resident UK belongers includes wives and children because the definition of UK belonger does so, is correct. In any event, there are other possible dependants and their position needs to be made clear. This new paragraph follows our own provisions regarding dependants. Hong Kong will need to take administrative action to put this paragraph into effect 3/Mr Wassall in the Visa Section will take care of issuing the instructions. Once final drafts has been agreed, Hey it should be sent to him and he will arrange
printing and distribution in conjunction with Procedures Section of Accommodation and Services Department. There is little prospect of getting instructions out by 1 April. I understand from him that the circulars will issue as a printed circulars (?) in the 'O' series, and that he will arrange for posts who are likely to need guidance early to receive their instructions telegraphically.
